01 Acceptance of Terms

By downloading, installing, or using the CHIKITSHA Online application or website ("Platform"), you ("User") agree to be legally bound by these Terms & Conditions ("Terms") and our Privacy Policy, which is incorporated herein by reference.

These Terms constitute a binding agreement between you and CHIKITSHA Online Private Limited ("Company", "we", "us"). We reserve the right to update these Terms at any time with 30 days' notice.

02 Our Services

CHIKITSHA Online provides a digital health marketplace including:

• Teleconsultation with registered medical practitioners
• Diagnostic lab test booking and home sample collection
• DNA testing kit delivery and analysis
• Digital health records and prescription management
• Medication reminders and health tracking tools

We act as an intermediary platform and are not ourselves a medical provider or diagnostic laboratory.

03 Eligibility

To use our Platform you must:

• Be at least 18 years of age, or have parental/guardian consent if a minor
• Be a resident of India or accessing the Platform from a legally permitted jurisdiction
• Provide accurate, current, and complete information during registration
• Not be barred from receiving services under applicable law

04 User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Notify us immediately of any unauthorised access at support@chikitsha.com
• Not share your account with others or create multiple accounts
• Provide truthful and accurate health information
• Not use another person's account or impersonate any individual

05 Medical Disclaimer

We do not guarantee the accuracy of any medical advice, diagnosis, or treatment provided by doctors on our platform. Medical decisions remain the professional responsibility of the consulting physician and the informed choice of the patient.

06 Vendor Terms

Healthcare providers (doctors, labs, phlebotomists) registered on our platform ("Vendors") agree to:

• Maintain valid licences, registrations, and accreditations at all times
• Adhere to the Indian Medical Council Act and applicable healthcare regulations
• Maintain patient confidentiality and comply with our Privacy Policy
• Not engage in fee-splitting, referral kickbacks, or any unethical practices
• Accept our commission structure as outlined in the Vendor Agreement

07 Payments & Billing

All payments on CHIKITSHA Online are processed through RBI-compliant payment gateways. By making a payment you confirm that:

• You are authorised to use the payment method provided
• All charges are in Indian Rupees (INR) and inclusive of applicable GST
• Refunds are subject to our Refund & Cancellation Policy
• We are not responsible for charges levied by your bank or card issuer

08 Intellectual Property

All content on the CHIKITSHA Online platform — including logos, brand name, design, software, text, graphics, and data compilations — is the exclusive property of CHIKITSHA Online Private Limited and is protected under Indian and international copyright, trademark, and other IP laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

09 Limitation of Liability

To the maximum extent permitted by law, CHIKITSHA Online shall not be liable for:

• Any indirect, incidental, or consequential damages arising from use of the Platform
• Medical outcomes resulting from consultations or treatments
• Service interruptions due to technical failures beyond our control
• Loss of data due to factors outside our reasonable control

Our total liability in any dispute shall not exceed the amount paid by you for the specific service in question.

10 Termination

We reserve the right to suspend or terminate your account at any time without prior notice if you violate these Terms, engage in fraudulent activity, or pose a risk to other users or the platform. You may delete your account at any time from the app's Profile settings. Termination does not relieve you of obligations for pending payments.

11 Governing Law & Disputes

These Terms are governed by the laws of India. Any disputes arising shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Kolkata, West Bengal.
